McCormick uses non-transparent containers that hide the amount of product inside, while Watkins uses smaller-sized containers that hold the same amount as McCormick’s. The lawsuit claims that McCormick’s marketing practices have harmed Watkins’ sales, as customers compare the two containers and assume they are getting more pepper for a better price with McCormick’s. However, in reality, the tins contain the same amount of pepper. In addition to Watkins’ lawsuit, angry customers who purchased McCormick’s new tins of pepper have filed a class-action lawsuit, claiming they were misled. These cases are currently going through the federal court system.
